What Constitutes a Wrongful Injury?

Washington, D.C. is one of the few jurisdictions that follow a contributory negligence rule, which is considered the harshest standard in personal injury law. Unlike modified comparative negligence, contributory negligence laws prohibit plaintiffs from recovering compensation in a personal injury claim if they are even slightly responsible for their injuries. 

This means that if you are only 1% at fault for the accident, you may be ineligible to recover damages. However, the Vulnerable User Collision Recovery Amendment Act of 2020 limited the application of contributory negligence in civil actions relating to collisions involving certain “vulnerable users” of public highways and sidewalks, such as cyclists, pedestrians, and users of non-motorized devices.
